HIMACHAL PRADESH PUBLIC SERVICE COMMISSION ADVERTISEMENT NO.XI /2009
Applications are invited on the web based Interface for applying
online ,from the eligible and desirous citizens of India, for admission to the
H.P. Judicial Service Competitive (Preliminary) Examination, 2010, based on
Multiple Choice Questions (100% objective type), to be conducted at Shimla
and Dharamsala in Kangra District (if adequate Nos. of candidates opt for
Dharamsala centre), followed by main written examination and viva voce, for
appointment to the following vacancies of Civil Judges, (Junior Division) in
the pay scale of Rs.9000-14550/- (pre-revised):-

The computation of the vacancies is subject to variation.
The number of vacancies in the service together with proportionate
reservation to various categories in respect of this examination may vary.
ESSENTIAL QUALIFICATIONS:
a) As on first of March, 2010, a candidate must be holder of degree in Law
as recognized by the Bar Council of India.
b) A candidate must be a citizen of India.
DESIRABLE QUALIFICATION: The knowledge of customs, manners and dialects of
Himachal Pradesh and suitability for appointment in the peculiar conditions
prevailing in the State of Himachal Pradesh.
AGE LIMIT: A candidate must have attained the age of 22 years but must not be
more than 30 years of age as on the last date prescribed for receipt of
applications in the Commission’s Office i.e. 1st March, 2010.
RELAXATION IN UPPER AGE LIMIT: The upper age limit is relaxable by 03
years for S.C. / S.T. and other prescribed reserved categories (OPRC)
candidates of Himachal Pradesh.
DISQUALIFICATIONS FOR ADMISSION TO THE EXAMINATION:
No person shall be eligible for admission to the examination:-
a) if he/ she has been dismissed from any previous service;
b) if he/ she has been convicted of any offence involving moral turpitude or
has been bound down for good conduct under the provisions contained
in Chapter VIII of the Code of Criminal Procedure, or has been
permanently debarred / disqualified from appearing in any examination
or selection;
c) if he / she is found either directly or indirectly influencing the selection
process in any manner;
d) if he is a man, has more than one wife living and if a woman, has
married a man already having another wife; or
e) if he / she is an un-discharged insolvent.
_ Every person applying for appointment to the service, at the bottom of
the prescribed application form, shall give a declaration that he does
not suffer from any of the aforesaid disqualifications and also that he
conforms to all the eligibility criteria. The declaration shall also contain
his undertaking that if the same is found false or incorrect, his
candidature shall be liable to be cancelled or if appointed, his
appointment shall also be annulled.
PROCEDURE FOR APPLYING ONLINE:
1. Examination Fees:
General / Unreserved category Rs.250/-.
SC/ST/OPRC Rs.63/-.
2. Demand Draft for examination fee may be prepared in advance in favour of
Secretary, H.P. Public Service Commission, Nigam Vihar, Shimla-2,
payable at Shimla before filing Application Form Online.
3. Candidates are required to visit at http/www.hp.gov.in/hppsc and click
the link to APPLY ONLINE for HPJS-2010.
4. Register yourself as a New User in H.P.P.S.C. website. Click the link “NEW
USER SIGNUP HERE” on the web page and fill the parameters of Name,
User ID, Password, Gender, E-mail ID, Security Question & Answer and
Date of Birth. Then press the button “Create User”. This User ID and
Password. will be applicable for all future references regarding this
examination. Then click the link Apply for Examination and Click to
Apply. Fill the Online form for the said examination by filling the
parameters of Name, Father’s Name, Date of Birth, Category, Examination
Centre, Address, Name & Address of two persons (for credential certificate
purpose), Bank Draft detail etc.
5. After filling-up the form, download the same and take the print on A-4 size
paper.
6. Paste your one recent photograph, sign in the specified box and send this
Application Form (alongwith Demand Draft) in 9” x 6” envelope by
Registered / Speed Post to “The Secretary, H.P. Public Service
Commission, Nigam Vihar, Shimla-171002” for further processing so as
reach latest by 01-03-2010. The application, complete in all respect can
also be deposited in the office of the Commission in person.
7. Firmly affix one recent high contrast passport size, preferably black and
white, photograph (taken on or after 01-01-2010) with gum / fevicol (not to
be pinned or stappled) in the space provided for it in the Application Form
duly attested by the Gazetted Officer. The photograph must indicate clearly
at the bottom of the photograph the name of the candidate alongwith the
date of taking the photograph. It should be without cap or goggles.
Spectacles are allowed. Polaroid photos are not acceptable. The photograph
of the candidate should be attested by the Gazetted Officer in such a way
that part of the signatures is on the photograph and remaining part of the
signatures is on the Application Form. Attestation should be done on the
bottom part of the photograph so that the photograph is not defaced.
Candidates may keep 2-3 identical photographs in reserve for use at the
time of examination / interview.
8. Candidates submitting the Applications Online are required:
• to attach Demand Draft of required fee in favour of Secretary, H.P.
Public Service Commission, Nigam Vihar, Shimla-2 payable at Shimla.
• to mention his / her Application Number, Name and Address on the
back of the Demand Draft.
• to retain a photo copy of the Application Form for future reference.
• to retain a photo copy of the Demand Draft sent.
• to retain the original receipt issued by the Post Office for having
dispatched the Application Form.
• the processing of the applications will begin only after receiving
Application Form and Fee ( by Demand Draft).
9. Online Application Form will be entertained only after receipt of duly signed
Application Form alongwith requisite documents in support of eligibility.
The applicants may see status of applications Online by entering his / her
User I.D. and Password.
10.
(1) The candidates are required to submit copies of following
certificates duly attested in support of their claims:
a) matriculation certificate or its equivalent ,showing the date
of birth.
b) graduation Degree / detailed marks certificate, issued by a
recognised university.
c) degree in Law recognized by the Bar Council of India.
d) the S.C. /S.T. / OPRC certificates. The S.C. /S.T. / OBC
certificates must be on paternal lineage on the proforma
prescribed by the Govt. and issued by competent authority
of the concerned area in Himachal Pradesh.
OBC certificate should not be more than two years old on
01/03/2010, at the time of main examination and viva-voce. The
OBC candidates also have to file affidavits that their status as
OBC has not changed and that they are not excluded from the
category OBC on account of being covered under creamy layer.
(2) The candidate shall also submit Original Certificates furnished by
two respectable persons unconnected with candidate explicitly
testifying to his character, good behaviour as well as antecedents.
11. Incomplete / defective applications / applications received after last date
or applications without prescribed fee or with lesser fee shall not be
entertained. The examination fees received with such applications will
not be refunded.
LAST DATE FOR RECEIPT OF APPLICATIONS:
The last date for receipt of applications, complete in all respects,
is First of March, 2010. The Commission will receive applications on 28-02-
2010 and 01-03-2010 irrespective of these days being Sunday and Holiday. No
applications will be received or entertained after 01/03/2010.
ADMISSION / REJECTION OF CANDIDATURE:
(i) Applications submitted in the proforma which is not prescribed,
improperly filled up, defective applications or applications with
inadequate fees or applications received after 01-03-2010 shall not be
entertained or shall be rejected straightway without providing
opportunity for corrections. Therefore, it is in the interest of the
candidates to fill up the applications carefully, submit them with
required documents / photographs and fees well in time.
(ii) The candidates are advised to carefully read the instructions contained
in this advertisement, in the H.P. Judicial Service Rules, 2004 and the
Himachal Pradesh Judicial Service (Syllabus & Allocation of Marks)
Regulations, 2005 as amended from time to time to ensure that they are
eligible for admission to this examination in terms of said rules,
instructions and conditions. The eligibility of candidates will be
determined on the basis of aforesaid Rules and Regulations. The
candidates who appear in the aforesaid examination, if found ineligible
subsequently, their candidature will stand cancelled. The eligibility of
candidates called for the interview will be determined on the basis of
original documents and the Commission will not be responsible if the
candidature of any candidate is rejected at that stage or at the time of
verification by the appointing authority. As such, admission to the
examination / interview shall be purely provisional.
(iii) Onus of proving that a candidate is eligible to apply for the post is on
the candidate only. If the date of notification / declaration of result is
not indicated in the degree/ certificate / marks list, the date of issue of
degree / certificate / marks list shall be deemed as date of acquiring
essential qualification.
(iv) The candidates claiming reservation must submit valid certificates of
concerned category in support of the claim. In case of invalid
certificates, the applications will be rejected. The category once claimed
shall not be changed.
If you belong to OBC category you are required to produce OBC
certificate, which should not be more than two years old at the time
of last date fixed for receipt of applications, main examination and
viva-voce, alongwith latest affidavit duly attested by the authority
authorized under the Indian Oath Act stating that your status as
OBC has not changed and you are not excluded from the category
of OBC on account of being covered under creamy layer. Such
certificate should be based on the lineage of parental family. You
will not appear in the examination or viva-voce, if you fail to bring
both these documents. No further time will be given for submission
of these documents after the examination / viva-voce.
(v) The names of those candidates whose applications are rejected or not
entertained will be put on the website of the Commission. The
candidates whose applications are not rejected shall be admitted
provisionally for the examination. The list of such eligible candidates
would be displayed on the website of the Commission on 02-04-2010.
SCHEME OF EXAMINATION:
1. Preliminary Examination:
The preliminary examination shall be an objective type examination consisting
of the following three papers of 100 Marks each:-
• Civil Law-I
• Civil Law-II
• Criminal Law
Each paper shall be of one-hour duration and the examination in all the
three papers shall be held on the same day. The syllabus for the preliminary
examination shall be the same as provided for Paper-I to III for the Main
examination. The preliminary examination will be held on 15-05-2010.
The result of preliminary examination will be declared on 15-06-2010
and shall be published and also displayed on official website of the
Commission. No individual intimation shall be given to the candidates.
2. Main (Narrative) Examination:
Main Examination will be consisting of 05 papers as follows:-
PAPER SUBJECT MARKS
PAPER-I Civil Law-I 200 Marks
PAPER-II Civil Law-II 200 Marks
PAPER_III Criminal Law 200 Marks
PAPER-IV English Composition 200 Marks
PAPER-V Language (Hindi) 100 Marks
Main Written (narrative) examination shall be held w.e.f. 12-07-2010
onwards. The date sheet will be put on the website of the Commission. No
individual intimation will be given.
3. Minimum Qualifying Marks:
(i) No candidate shall be credited with any marks in any paper unless he
obtains at least 45 percent marks in that paper, except Hindi language
paper (paper-V) in which candidate should obtain at least 33 percent
marks.
(ii) No candidate shall be considered to have qualified the written test
unless he obtains 50 percent marks in aggregate in all papers and at
least 33 percent marks in language paper i.e. Hindi in Devanagri script.
4. Syllabii:
Syllabii for main(narrative) examination will be as follows:
Paper-I (Civil Law-I)
Code of Civil Procedure. Indian Evidence Act, Indian Stamp Act,
Himachal Pradesh Courts Act, 1976 and Specific Relief Act.
Paper-II. (Civil Law-II)
Indian Contract Act, Hindu Law, Indian Limitation Act, Transfer of
Property Act and H.P. Urban Rent Control Act.
Paper-III. (Criminal Law)
Indian Penal Code, Criminal Procedure Code, Chapter-XVII (section
138 to 143) of the Negotiable Instruments Act, Punjab Excise Act as
Applicable to the State of H.P., Wild Life Protection Act and Indian
Forest Act.
Paper-IV. (English Composition)
A Choice from three Essays on General Subjects.
ESSAY: 150 Marks
Translation of Hindi Passage into English: 50 Marks

Total : 200 Marks

Paper-V. (Language)
Hindi (in Devanagri Script) No books prescribed. The paper of Hindi will
comprise of the following:-
Translation of English passage into Hindi. - 30 Marks
Essay in Hindi on any topic out of three. - 50 Marks
Composition (Idioms and Corrections etc.).- 20 Marks

(The standard for the language paper shall be that of
Matriculation examination of the Himachal Pradesh Board of
School Education)
Note:-
(i) Bare copies of legislative enactments only will be
supplied.
(ii) Each paper will last for three hours. Paper I to IV will carry 200
marks each and Paper V 100 marks.
VIVA- VOCE
_ Candidates who qualify the Main written examination, will be required
to appear at such place, as may be fixed by the Commission, for a vivavoce
test. The maximum marks for the viva-voce shall be 100. The
marks obtained in the viva-voce will be added to the marks obtained in
the Main written examination for purpose of selection of the candidates.
• The summoning of the candidates for viva-voce test conveys no
assurance whatsoever that they will be selected or recommended.
Appointment orders to the selected candidates will be issued by the
Government.
OTHER CONDITIONS
• The Commission reserves the right to allot any Centre of examination to
any candidate. No request for change of centre will be entertained. The
main written examination will be conducted at Shimla.
• The inclusion of a candidate in the list of successful candidates shall
not confer any right to appointment unless the Government is satisfied
after such inquiry as may be considered necessary that the candidate is
suitable in all respects for appointment in service before actual offer for
appointment is made. The selected candidates will also be subjected to a
Medical Examination in accordance with guidelines prescribed by the
Hon’ble High Court under Rule- 9 of H.P. Judicial Service Rules, 2004
read with Regulation ‘8’ of the H.P. Judicial Service (Syllabus and
Allocation of Marks) Regulations, 2005.
• The candidates, who may be admitted to the examination, will have to
write in their own hand. In no case can an amanuensis be allowed.
• The Commission does not supply any articles of stationery except
authorised Computerised Answer Sheet for preliminary examination and
Answer Books, continuation sheets for use in the main written
examination. Items such as pen, Ink, whatsoever needed have to be
brought by the examinees themselves.
• Re-evaluation or rechecking of Answer Sheets / Answer Books (Scripts)
is not permissible nor the Commission enters into correspondence in
this regard.
• It may be ensured by the candidates before submitting the applications
that furnishing of false information and documents or suppression of
any factual information in the application form would entail
disqualification. If the fact that false information / document(s) has
been furnished or that there has been suppression of any factual
information in the application comes to notice at any time during the
service of a person, his service would be liable to be terminated. No
columns should be left blank in the application form.
• In case candidate has any doubt or objection about any question(s) in
the question paper, he/she is advised to give a representation, in writing
immediately after the examination is over (the same day) in the name of
the Secretary, H.P. Public Service Commission to the centre supervisor
and no representation shall be entertained thereafter.
